Part-21 aircraft

Aircraft regulated under the UK Basic Regulation and its implementing rules. Cost sharing in them is governed by NCO.GEN.102.

Also called: Part 21 aircraft

CAP 1590 (guidance), para 31 explains:

‘Part 21 aircraft’ are regulated in accordance with Assimilated Regulation (EU) 2018/1139 (known as the ‘UK Basic Regulation’) and the implementing regulations made under it.

Certified light aeroplanes are the typical example. For these aircraft the cost sharing rules sit in the Air Operations Regulation: Article 6(4a)(a) allows cost-shared flights, and NCO.GEN.102 sets the conditions. The flight is then flown under Part-NCO, the non-commercial operating rules.

CAP 1590 para 7 says the derogation "allows flights involving UK registered Part-21 aircraft that would otherwise be considered CAT to be flown in accordance with the operating rules for non-commercial flights (such as cost sharing flights) subject to specific conditions." Para 9 limits the arrangements to other-than-complex motor-powered Part 21 aircraft.

If your aircraft is not Part-21, for example a permit aircraft or a microlight, the equivalent rules are in ANO 2016 art. 13 instead. See non-Part-21 aircraft. The conditions are almost identical either way.
