NCO.GEN.102

The Part-NCO rule, in force since 1 October 2025, setting the nine conditions every cost-shared flight in a Part-21 aircraft must meet.

Also called: NCO.GEN.102 Cost-shared flights

NCO.GEN.102 opens: "Cost-shared flights referred to in Article 6(4a)(a) must comply with the following:". In summary:

Point Condition
(a) "No more than six persons (including the pilot) are to be carried on the flight."
(b) All costs other than direct costs paid by the pilot
(c) Each contribution no more than "the total direct costs divided equally by the number of persons carried (including the pilot)"
(d) "The flight must be operated by a private individual."
(e) No pilot employed or contracted as a pilot for the flight
(f) Passengers clearly advised the flight does not meet CAT safety standards
(g) A record for each passenger, with their signed declaration
(h) Records completed before the flight, kept 6 months, produced to an Authorised Person on request
(i) Rules on who places adverts and what they must include

It was inserted by SI 2025/878 and came into force on 1 October 2025. The CAA's guidance on it is in CAP 1590 and in GM1 NCO.GEN.102(c) and AMC1 NCO.GEN.102(g).

NCO.GEN.102 applies to Part-21 aircraft. For non-Part-21 aircraft, ANO 2016 art. 13(2) and (3) set out the same criteria, with small differences: references to "CAT or PT", and adverts may be placed "by the pilot or operator of the flight". The compliance checklist walks through each point.
